Special Education & School Law

We represent families of students with disabilities and those who have no disabilities in matters involving both public and private education.   We have substantial experience and the tools necessary to help parents navigate the special education process and to advocate, negotiate and resolve disputes related to their child’s education:

  • Consultation and advice regarding special education in general and the obligation to provide a “free and appropriate public education”

  • Securing public funding for a private school placement
  • Review and analysis of evaluations conducted both by the school district and outside evaluators
  • Individualized Education Plan (“IEP”) drafting, review, negotiation and implementation

  • Dispute resolution, mediation and negotiation
  • §504 Plan drafting, review, negotiation, implementation and follow up
  • IEP Goal setting, social-emotional mental health and well-being and addressing challenging adolescent issues pertaining to school
  • Bullying, cyberbullying and harassment
  • Medical plans and medical conditions, hospitalization, leaves of absence and home and hospital services (tutoring)
  • Accommodations for school and academic testing
  • Consultation pertaining to extended school year (ESY) and prevention from substantial regression when school is not in session
  • Staffing and qualifications of those rendering “specialized instruction”

Given our firm’s experience in this area, we also complement our Special Education and School Law practice with the ability to provide for special needs trust planning and transition planning beginning at age 14.   Where appropriate, we also provide legal advice and consultation with respect to petitions for guardianship and conservatorship.
